If someone doesn't adhere to a stipulation of settlement from court what is the next step to get our $ back?
We recently sued our old landlord because he didn’t return our security deposit. We went to court and came to a stipulation of settlement agreement which we both signed. He had 2 weeks to return a certain amount of money and failed to do so. I went to the courthouse and filed a breach of stipulation of settlement. The employee at the courthouse said that if we knew where he worked they could do something to get the money back but i didn’t know his place of employment. I did however fill out a form that says if he tries to buy or sell property(which will probably never happen) that he has to return our money before doing so. I really don’t know what our next step is to get our money back in a timely fashion. Does anyone have any suggestions?


You could pull a credit report or one of those online background checks on him to find out his employer, then file for a garnishment.

I’m the person who ‘thumbed up’ the first responder. That’s exactly what I’d do.

However, maybe the landlord’s sole employment is owning apartment buildings. If so, he is self-employed and cannot be garnished. I don’t think a person’s taxes can be garnished unless the government is the one who has won a suit against him or her.

It happens all the time in small claims court: a person sues, wins…but doesn’t collect. There isn’t a whole lot you can do about it. The good news (if this is any consolation) is that he has a judgment filed against him and it will affect his credit rating.

Many landlords pull that crap all the time. They know they can get away with it. Going to court is just the ‘cost of business’ and a lot of them have been sued numerous times.

It’s frustrating as hell–I’ve been there, my boyfriend has been there. We feel your pain.
